The mayor of the Brčko District of Bosnia and Herzegovina has delivered a notice to all the competent authorities in Bosnia and Herzegovina and the Region on the 16th of February 2015, in which he states that the Europski univerzitet (European University) and the Internacionalni univerzitet (International University) both hold licences and should be included on the Information on the higher education institutions in BiH, which is compiled and published by the Centre for Information and Recognition of Qualifications in Higher Education on its website.

 

This information caused additional concern and confusion of the public and especially the persons who obtained their degrees at these higher education institutions. Therefore, we would like to inform all interested parties on the following:

The Centre for Information and Recognition of Qualifications in Higher Education collects and publishes Information on the higher education institutions in Bosnia and Herzegovina based on the information obtained from the competent education authorities (Ministry of Education and Culture of the Republic of Srpska, cantonal ministries of education and the Department of Education of the Government of Brčko District of BiH).

In accordance with the above mentioned, as well as the Article 14 of the Law on Higher Education of the Brčko District of BiH (Official Gazette of Bosnia and Herzegovina, No. 30/09) which stipulates that the Department of Education of the Government of Brčko District of BiH is competent for “…making decision on issuing a license to the higher education institution and its department with the headquarters located outside of the District; verifying the conditions for the start of work and further work of the higher education institution; making decision on the fulfilment of the conditions for the start of work of the higher education institution; making decision ordering elimination of deficiencies in the work of the higher education institution; making decision on prohibiting the work of the higher education institution in the case of non-fulfilment of the conditions;…”, we had contacted the competent Department of Education of the Brčko District of BiH and, on the 16th of February 2015, received the following information:

"According to the Decision of the Department of Education of the Government of the Brčko District of BiH, No. 37-000056/14, Act No. 1003MП-001/14 from the 23rd of January 2014, the European University had its license taken away and was prohibited to provide higher education. Regarding the above mentioned decision, an administrative dispute at the Basic Court of the Brčko District of Bosnia and Herzegovina is already in process, based on the Decision of the Appellate Court of the Brčko District, No. 96 0 У 074737 14 Уж from the 26th of August 2014. This university's initial lisence was, in accordance with the provisions stipulated by the Act 29, Paragraphs 5) and 6) of the Law on Higher Education of the Brčko District of BiH (Official Gazette of Bosnia and Herzegovina, No. 30/09) valid for the maximum of two years and has ceased to be valid since it hadn’t had its new licence issued.

In that respect, the diplomas and other public documents issued by this higher education institution are not recognized in BiH, in accordance with the provisions stipulated by Article 37, Paragraph 2) of the same Law which stipulates that academic, professional and scientific titles, diplomas and other public documents issued by the unaccredited and unlicensed institution should not be recognized. Given the above, the European University of Brčko should not be included on the Information on the higher education institutions in BiH."

 

Regarding the International University of Brčko, the above mentioned Department of Education of the Brčko District of BiH gave us the following reply:

"The Department of Education of the Government of Brčko District of BiH initiated an administrative supervision on the legality of work and acts of the International University of Brčko which is still in process.

The verdict of the Appellate Court of Brčko District of Bosnia and Herzegovina confirms that the Department of Education had determined all significant facts, had not exceeded its authority and had acted according to the rules of the process of administrative supervision.

Since the requirements for the termination of the process of administrative supervision have not been fulfilled yet, the real state of affairs and all the relevant facts cannot be determined. With that respect, no valid and legally based decision can be made in accordance with which the International University of Brčko could be granted to provide higher education. With respect to the above mentioned, the International University of the Brčko District of BiH does not hold the required licence. Its temporary licence expired on the 11th of January 2014. Therefore, the International University of Brčko should not be included in the Information on the higher education institutions in BiH."

 

With full regard to the jurisdiction and the institution of the Mayor of the Brčko District of BiH, it is important to note that all of the above mentioned proves that the Mayor of the Brčko District of BiH has no jurisdiction to issue operating licenses to the higher education institutions in the Brčko District of BiH. As was previously highlighted, the Department of Education of the Government of the Brčko District of BiH has the exclusive jurisdiction for issuing licenses and making decision on the fulfillment of requirements for the start of work of the higher education institution.

 

Therefore, based on the competences of the Centre (Articles 44 and 45 of the Framework Law on Higher Education in Bosnia and Herzegovina (Official Gazette of BiH, Nos. 59/07 and 59/09) and the above mentioned competences of the Department of Education of the Government of the Brčko District of BiH, the Centre considers the information received from the Department of Education of the Brčko District of BiH regarding the status of the higher education institution in the Brčko District of BiH, as the only one relevant.
